Terms of Service

1. Agreement to Terms

These Terms of Service (the "Terms") govern your access to and use of the Puzzle Book Smith service, website, and software (together, the "Service") operated by Puzzle Book Smith (the "Company", "we", "our", or "us"). By creating an account, signing in, or otherwise accessing the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

The Service provides web-based tools for designing, generating, and exporting puzzle books and related content for personal and commercial use. The Service includes both deterministic generation tools (e.g., grid-based puzzles from supplied word lists) and artificial intelligence ("AI") generation tools that produce content using third-party machine learning models.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account. You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account.

4. Plans, Credits, and Cancellation

The Service operates on a subscription model with three categories of usage credits (collectively, "Credits"):

• Subscription Credits: issued at the start of each billing period and consumed first when you perform a credit-based action.
• Rollover Credits: unused Subscription Credits that carry forward into the next billing period subject to a per-plan cap; consumed second.
• Purchased Credits: credits acquired through one-time token-pack purchases; consumed last.

You may cancel your subscription at any time via your billing settings or by contacting support. Cancellation prevents future renewals; you retain access to subscription features through the end of your then-current billing period.

Upon cancellation, all unused Credits, including Purchased Credits, expire at the end of your then-current billing period. Purchased Credits are not refundable. Token-pack purchases are final at the time of sale and do not entitle you to a cash refund under any circumstance, except where required by applicable law.

We reserve the right to change subscription pricing or Credit costs at any time. Changes affect future billing periods only and will not retroactively reprice an action that has already been taken.

5. AI Use and Acceptance of Risk

The Service makes use of third-party AI models to generate puzzle content, instructions, metadata, and other outputs (collectively, "AI Output"). AI models are probabilistic and imperfect. AI Output may contain factual errors, low-quality content, content that is unsuitable for your intended audience, or content that fails to satisfy a generation request. You acknowledge and accept this risk.

You are solely responsible for reviewing AI Output before use, publication, or commercial distribution. The Company makes no representation or warranty that AI Output is accurate, complete, fit for a particular purpose, or appropriate for your audience.

Credits consumed by a credit-based action are not refundable on the basis that the resulting output was unsatisfactory, contained errors, was rejected by you, or failed to meet your expectations. This includes, without limitation, failures or low-quality results arising from over-complicated, ambiguous, or unsupported generation requests. By initiating a credit-based action, you consent to the consumption of the applicable Credits regardless of the outcome of that action. Credits are non-refundable. No exceptions are offered.

6. Your Content

You retain all rights to the puzzle books, custom word lists, images, and other materials you create using the Service ("Your Content"). You grant the Company a limited, non-exclusive license to host, store, and process Your Content solely for the purpose of operating the Service for you. We do not sell, license, or otherwise commercially exploit Your Content.

7. Acceptable Use

You agree not to use the Service to generate, store, or distribute content that is illegal, infringing, harassing, sexually explicit, exploitative of minors, or designed to evade content filters. We may suspend or terminate accounts that violate this section without refund.

8. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising under these Terms shall not exceed the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any breach of these Terms. You may terminate your account at any time. Termination does not entitle you to a refund except as expressly provided in Section 4.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or via in-app notice at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
